Commitment of Babcock Borsig Service to Data Privacy Protection
Protecting the security and privacy of personal data is important to us. Therefore, we conduct our business in compliance with applicable laws on data privacy protection and data security. The information outlined below will tell you what data we may collect and how we deal with them.

Personal Data
Through our Web sites we will not collect any personal data (e.g. names, addresses, telephone numbers or e-mail addresses), unless you voluntarily choose to provide us with such data (e.g. by registration) and/or unless you provide your consent, or unless otherwise permitted by applicable laws and regulations on the protection of your personal data.

Purpose of Use
We will only use personal data provided by you to respond to your inquiries, to process your orders or to provide you access to specific information or offers. We will not pass on your personal data to third parties outside the Babcock Borsig Service Group.

Purpose Limitation
Babcock Borsig Service will collect, process and use the personal data supplied by you online only for the purposes communicated to you, unless the collection, processing or use

is necessary to prepare, negotiate and perform a contract with you,

is required by law or by order of governmental or judicial authorities,

is necessary to establish or preserve a legal claim or defence,

is necessary to prevent misuse or other illegal activities, such as e.g. wilful attacks on Babcock Borsig Service systems

GUARANTEE OF DATA SECURITY

Communications or Utilisation Data
Through your use of telecommunications services access to our Web sites, your communications data (e.g. Internet protocol address) and/or utilisation data (e.g. information on the beginning and duration of access and on the telecommunications services used by you) are technically generated and could allow conclusions to be drawn about personal data. To the extent that there is a compelling necessity to collect, process and use your communications or utilisation data, this will be subject to the legal provisions on data privacy protection.

Non-Personal Data Collected Automatically
When you access our Web sites we may automatically (i.e. not by registration) collect non-personal data (e.g. type of Internet browser and operating system used; domain name of the Web site from which you came; number of visits; average time spent on the site; pages viewed). We may use these data to monitor the attractiveness of our Web sites and to improve their efficiency and content.

"Cookies" - Information Stored Automatically on Your Computer
When you view our Web sites, we may store some data on your computer in the form of a "cookie" to automatically recognise your PC next time you visit. DISCLAIMER

Babcock Borsig Service GmbH and its subsidiaries as the suppliers of content are responsible according to § 8 of the Teleservices Act for "their own contents" made available by them. Although all contents are carefully reviewed and updated periodically, we cannot guarantee for completeness, correctness and up-to-dateness. Therefore, Babcock Borsig Service GmbH and/or its subsidiaries are not liable for damage connected with the use of these contents.

Our own contents are to be distinguished from cross references ("LINKS") to contents provided by other suppliers. Through the cross reference Babcock Borsig makes the use of "external contents" available in a manner identified as:

EXTERNAL LINK.

Through the cross reference Babcock Borsig Service GmbH provides access to the use of such contents (§ 9 of the Teleservices Act). It is not responsible for these "external contents" because it does not initiate the transmission of the information, does not select the addressee of the transmitted information and has also not selected or changed the transmitted information. Due to the selected call and linkage method no automatic short-term intermediate storage of these "external links" is effected by Babcock Borsig Service GmbH so that in this respect no responsibility arises for Babcock Borsig Service GmbH for these external contents.

"LINKS" are always references to "live" (dynamic) Internet representations of third parties. When Babcock Borsig Service GmbH and/or its subsidiaries provided the link for the first time they checked the external contents to see if it might lead to any responsibility relating to civil law or criminal law but they are not obligated to continuously check the contents to which they refer for changes which might give new reasons for responsibility. They will cancel the cross reference, if this is technically feasible and reasonable, not until they notice or not until it is pointed out to them by others that a concrete offer to which they have provided a link produces a responsibility relating to civil law or criminal law. The technical feasibility and reasonableness will not be affected by the fact that even after cancellation of access from the homepage of Babcock Borsig Service GmbH, access to the illegal or criminal offer can be made from other servers.
